h. the defects are derived from aggressive environmental conditions,

saltiness, and external agents such as lime deposits or alterations due to

ice or sand, debris, ferrous slag, impurities of all kinds and bodies in the

pipes or water or from lightning over-voltage and over-current, insufficient

or irregular power supply (electronic faucets);

i. The deterioration of the surface is attributable to the use of aggressive

cleaning products containing acids or abrasive substances, anti-scale

products, powdered cleaning products, bleach, muriatic acid, acetic

acid or vinegar, sulfuric acid, sodium products, formic acid, acetone,

and trichloroethylene, or the deterioration is dependent on hair dye,

household disinfectants, substances to clean silver or ceramic products.

The durability of

finishes is also determined by the user’s reasonable care

and gentle use. It is strongly recommended that surfaces be cleaned with

soap and water using a soft cloth;

The warranty is limited to repairing or replacing defective products with

the absolute exclusion of any liability for damages directly or indirectly

caused by using the product to persons, things, or animals resulting from

the suspension of service or malfunction. In addition, compensation for

assembly or disassembly of the product, travel expenses, and costs of

technical interventions by authorized personnel are excluded.

10. Returns: Rubinetterie F.lli Frattini S.p.A. undertakes to replace

defective goods only if they are returned in good condition and packaged

in the original packaging as shown below:

a. returns must be authorized in advance by Rubinetterie F.lli Frattini S.p.A.

employing a form to request from the e-mail address: ordini@frattini.it

b. each return authorization will be identi

fied with a reference number; all

return-authorized products must be sent collect.

c. will not be considered:

Inappropriately packaged returns to avoid damage in transit,

disassembled, and dirty products.

Rubinetterie F.lli Frattini will examine each case and assess whether the

conditions for the operation of this warranty exist, reserving the right to

deny repair or replacement if there are grounds for exclusion.

If the defects stated in the form are not found, the Seller will notify the

Buyer, and the products will remain available for 30 days from the date

of the notification. At the expiration of 30 days, the products will be

scrapped.

11. The Buyer acknowledges that the firm, sign, and trademarks, and in

any case, any industrial property right registered, used, or traceable to

Rubinetterie F.lli Frattini S.p.A., are the exclusive property of the same. The

Buyer may not claim any rights or ownership concerning the company,

the sign, the trademarks, and in any case any industrial property right,

the use of which is also prohibited in any way and any form, by way of

example but not limited to, on products, catalogs, and brochures, in

advertising and promotion, on the Internet and social media, without the

prior written consent of Rubinetterie F.lli Frattini S.p.A. This neither directly

nor indirectly, through third parties, companies and entities.

The offline and online use of industrial property rights, and in particular

the trademarks held by Rubinetterie F.lli Frattini S.p.A, as well as the

texts, descriptive sheets, and images (including photographic), audio

and video content and illustrations of the products (from now on, for the

sake of brevity, also jointly referred to as: “Product Graphics”) that are

transmitted by Rubinetterie F.lli Frattini S.p.A. - or in any case acquired by

the Buyer - for the sole purpose of enabling the resale of said products,

by the Buyer himself, where permitted, shall take place following the

directives established by Rubinetterie F.lli Frattini S.p.A. and, in any case,

in compliance with the regulations in force, including those on intellectual

and industrial property and those on advertising.

Trademarks, images (including photographs), and illustrations of products

the Buyer used offline and online must be accompanied by an appropriate

indication that they are the property of Rubinetterie F.lli Frattini S.p.A.

The use, where permitted, both of

fline and online of the Rubinetterie F.lli

Frattini S.p.A. trademark by the Buyer must always respect the font, size,

proportions, colors, and graphics indicated by Rubinetterie F.lli Frattini

S.p.A.

Without prejudice to the previous, about the online use of the Rubinetterie

F.lli Frattini S.p.A. brand and the Graphics of the products marketed

by Rubinetterie F.lli Frattini S.p.A. on Facebook, Instagram, Twitter,

LinkedIn pages, or other social networks traceable to the Buyer, the

Buyer undertakes, in addition, to comply with the following additional

requirements:

- the brand and Graphics of the products (and, in any case, any

denomination, image, or text that identi

fies the company or the products

marketed by it) must be displayed on the Reseller’s social pages in

a manner appropriate and adequate to the prestige of the products

manufactured and marketed by Rubinetterie F.lli Frattini S.p.A;

- by signing for acceptance of these General Conditions of Sale, the Buyer

undertakes to assiduously monitor his social network pages to avoid the

publication and permanence on them of any comments /or other content

(for example, audio and video) of a denigrating, defamatory, discriminatory,

insulting, offensive and obscene nature and, in particular, of any posts,

comments and content that may, directly or indirectly, undermine the

prestige of the brand Rubinetterie F.lli Frattini S.p.A. or harm, in any other

way, the products and image of Rubinetterie F.lli Frattini S.p.A. In the

event of publication of similar comments or content, the Buyer agrees to

take immediate action so that the words mentioned above or content are

promptly removed or blocked from the social pages of the same Buyer

and to give prompt notice of the incident to Rubinetterie F.lli Frattini S.p.A.,

for all the initiatives that the latter will deem appropriate.

Rubinetterie F.lli Frattini S.p.A. reserves, in any case, the right to revoke, at

any time and without prior notice, upon simple written notice to the Buyer,

the authorizations granted to the Buyer for offline or online uses of the

Rubinetterie F.lli Frattini S.p.A. Product Graphics and Trademark.

12. Jurisdiction: Any dispute relating to the application, execution, or

interpretation of the contract or these General Conditions of Sale shall be

devolved to the exclusive jurisdiction of the Court of Novara.

Rubinetterie F.lli Frattini Spa reserves the right to modify at its discretion, changes on products, technical and commercial information.
